By scheduling and participating in a StudioFlex Strength Assessment with StudioFlex, LLC (“StudioFlex”), you acknowledge and agree to the following:

1. Voluntary Participation and Assumption of Risk
You acknowledge that participation in fitness activities, including strength training, movement assessments, and related physical activities, is voluntary and involves inherent risks. These risks include, but are not limited to, muscle strains, sprains, joint injuries, falls, cardiovascular events, aggravation of pre-existing conditions, or other bodily injury. You voluntarily and knowingly assume all risks associated with participation.

2. Release and Waiver of Liability
To the fullest extent permitted by law, you release, waive, discharge, and hold harmless StudioFlex, LLC, its owners, members, employees, contractors, agents, and representatives from any and all claims, demands, causes of action, damages, liabilities, or losses arising out of or related to your participation in the Strength Assessment, including claims based on alleged negligence of StudioFlex.

3. Indemnification
You agree to indemnify and defend StudioFlex, LLC against any claims, liabilities, damages, or expenses (including reasonable attorney’s fees) arising from your participation or from your failure to disclose relevant medical conditions.

4. Medical Representation and No Medical Advice
You represent that you are physically capable of participating in physical exercise and have disclosed any known injuries, medical conditions, or limitations that may affect your participation. You understand that StudioFlex does not provide medical advice, diagnosis, or treatment, and that any information or guidance provided is not a substitute for professional medical consultation.

5. Emergency Authorization
In the event of a medical emergency, you authorize StudioFlex to obtain medical assistance on your behalf if deemed necessary. You agree to be responsible for any resulting medical expenses.

6. Governing Law and Severability
This agreement shall be governed by the laws of the State of California. If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

7. Binding Effect
This waiver is binding upon you and your heirs, executors, administrators, and assigns, and shall remain in effect for all participation in activities at StudioFlex unless superseded by a subsequently executed agreement.
